Supervisor abruptly concludes petition hearing
Last night, Greenburgh Town Supervisor Paul Feiner held a hearing as to the legal sufficiency of Edgemont’s second petition for incorporation. Thanks to all who attended—your presence was important! You can watch the entire proceedings by watching below.
In summary, there were six objectors, only two of which revealed the substance of their objections. The other four apparently coordinated with each other to indicate only the general nature of their objections with details submitted in writing only at the hearing.
Mr. Feiner aided and abetted this apparently coordinated effort by choosing to abruptly conclude the hearing. In doing so, he denied the public a full and fair opportunity to hear the objections and respond. As a result, all he (and the public) heard was a one-sided set of objections. This is in sharp contrast to 2017, when the Supervisor did allow testimony as to the objections per NYS Village Law.
After the hearing was closed, the EIC received the objections. They are accessible here. Of particular note, one objector asserts that the petition did not include a sufficient list of Edgemont students. He believes the EIC should have acquired the names and addresses of minors living in the community using investigative tools available on the internet.
Village Law 2-208 provides that the Supervisor must render his decision within 10 days of concluding the hearing (i.e. no later than July 26th), and must publish it within 15 days (July 31st). We continue to evaluate all options as we await Mr. Feiner’s ruling.
