Court Hears Feiner’s Third Appeal on Edgemont’s Right to Vote

We hope you’ve had a wonderful summer! There’s some fresh news to report on the incorporation front:
As you’ll recall, in the summer of 2024, the Edgemont Incorporation Committee (EIC) filed a third petition to let Edgemont residents vote on whether to become a village within the Town of Greenburgh. Soon thereafter, Supervisor Feiner rejected the petition. But in March of 2026, the New York State Supreme Court (County of Westchester) overturned that rejection. The court held that the “2024 incorporation petition is legally sufficient, and thus the election should proceed to decide the question of the incorporation of the proposed Village of Edgemont.” The Supervisor then appealed that decision to the Appellate Division of the Second Judicial Department.
The new development is that the Appellate Division has now scheduled oral arguments for September 8th in White Plains (we are #16 on the calendar).
If we prevail, the Supervisor could ask the New York Court of Appeals–the state’s highest court–to hear the case. If the Court of Appeals declines (or hears the case and then rules in our favor), Edgemont residents will finally get to vote on whether to become Greenburgh’s seventh incorporated village.
